KoH Virtual Servers leases virtual servers to many clients. Our policies are designed to provide each client with the best possible service and protect our best interests and the best interests of our clients.
About This Document
KoH Virtual Servers, Inc. is referred to as "KoH", "KoHvs", "us", "we", "our", "ours"; and our customers are referred to as "the customer", "you", "your", "they", "them". This document is referred to as "Terms of Service", "TOS", and "our policies."
This TOS document includes these sections:

Your use of KoH's services and/or products constitutes acceptance and agreement to these terms, conditions, and policies.
KoH reserves the right to change the ToS without notice.
Usage Policy
KoH Virtual Servers, Inc., reserves the right to refuse service to anyone, and to suspend or cancel any account.
Legal Age
To use our services, you must be of legal age to form a binding contract.
Contact Information / Account Security
You must provide us with current and accurate contact and billing information at all times. Providing false contact information of any kind may result in the termination of your account.
You are responsible for maintaining the confidentiality of your account information. You are responsible for all activities that occur under your account. You are solely responsbile for all content on your account. You agree to notify KoH immediately of any unauthorized use of your account or any other breach of security.
KoH will not be liable for any claim, loss, fees, or damage arising from your failure to provide us with accurate information, or your failure to keep your account secure, including any claim, loss, fees, or damage resulting from the termination and/or suspension of accounts due to inaccurate or unusable contact information.
Unacceptable Conduct
These activities are prohibited and will result in the immediate suspension or cancellation of your account, without notice and without refund, and with the possibility that KoH will impose fees and/or pursue legal redress without advance notice. You are solely responsible for the content on your virtual server.
- Illegal content of any kind, including, but not limited to the transmission, storage, or presentation of child pornography, threats to the person or property of others, fraud, terrorism, unsolicited e-mail (spam), racist or hateful material of any kind, copyright violations of any kind, trade secrets, or any information, data or material in violation of any United States Federal, State or City law.
- Sites advertised via SPAM are not permitted, including SPAM sent via fax, email, instant messaging, usenet/newsgroups, or any other method. Any account which results in our network being blocked or blacklisted will be terminated immediately. KoH reserves the right to determine, unilaterally, what constitues a violation. If KoH investigates a SPAM claim, and such charges are found to be true, KoH will bill the violator for both the expense of investigation and the cost of cleanup. A minimum of USD $500.00 per incident will apply.
- Using the KoH network in anyway harmful to KoH operations, or those of our customers.
- Providing false contact or financial data, including fraudulent use of credit card numbers.
Content
You are solely responsible for any and all content on your virtual server. You agree that you are responsible for maintaining your own account. You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, files, attachments, or other materials are your sole responsibility. KoH reserves the right review all data stored on KoH servers.
Technical Support
Technical Support can be obtained in three ways:
- Submitting an issue report from the Control Center left menu.
- Sending an e-mail to tech@kohvs.com
- By phone at 415-754-3900
In order to keep the cost of your virtual server as low as possible, KoH does not offer free, unlimited technical support. We're pretty reasonable about technical issues: first of all, if our network isn't working properly, we want to hear from you as soon as possible. If the issue is with our servers or our network, there is never a charge for technical support. If the issue is with installing, configuring, or maintaining your virtual server's operating system, you will be offered the opportunity to purchase technical support at our current shop rate. It's simply not possible for us to offer free support for issues pertaining to OS installation and configuration.
Billing and Payments Policy
Billing is monthly, on the anniversary date of your initial activation. Your first payment will be made by credit card at the time you sign up. We do not set up automatic recurring payments at that time. In due course, you will receive an invoice by e-mail. You may choose ongoing automatic billing at that time.
If your credit card is declined, or your payment is late, we don't summarily terminate your account. Every effort will be made to contact you and resolve the issue. Accounts more than 15 days past due are subject to immediate termination at our sole discretion.
In the case of late payment, data will be removed from our network at the time of final termination, at our sole discretion, but not within the 15-day grace period. Again, we make every effort to be reasonable, and we will make such decisions on a case-by-case basis. Late fees and re-activation fees may apply.
Privacy Policy
We do not store credit card numbers on our network. All financial data is stored on the ultra-secure networks of our credit-card merchant-services provider and their immediate partners.
We do not share your contact information with anyone, for any reason, with the exception of law-enforcement authorities by due process.
Refund Policy
Service is month-to-month, no refunds will be issued. In case of cancellation, service will continue until the end of the the paid period.
